1. Terms and Conditions
These Terms and Conditions will govern the purchase of any goods (“Goods”) or service ("Service") including training courses you attend with IPM Services (NZ) Limited through the Website or email or phone. You should read and ensure you understand these Terms before ordering (“Order”) any Goods or Services including booking or registering for any training courses, through this Website or email or phone. If you do not agree with any of these Terms you must not Order Goods or Services or register or attend any training courses from IPM Services (NZ) Limited directly of via our Website or email or phone.
Registration and/or attendance at any training course, including acceptance of any service due for payment is acceptance and agreement with these Terms and Conditions, as shown on our website https://www.ipmservices.co.nz/w/termsandconditions/. By using this Website, registering for a course and/or by physically attending one of our courses you acknowledge that you have read, understood and accept these Terms.
2. Conditions of use and our Privacy Policy
In addition to these Terms and Conditions, the Privacy Policy also governs your access to and use of the Website. You should ensure that you have read the Terms and Conditions in conjunction with the Privacy Policy . By registering for a course and/or accessing the Website you are deemed to have read and agree to be bound by the Terms and Conditions the Privacy Policy and these Terms and Conditions.
3. Amendments
IPM Services reserves the right to amend these Terms and Conditions from time to time. Amendments will be effective immediately upon being placed on the Website. Your continued use of the Internet Sites following such amendments being placed on the Website will represent an agreement by you to be bound by these Terms and Conditions as amended. Such amendments may include replacing these Terms and Conditions with entirely new Terms and Conditions.
4. Payment and Credit
Payment must be effected in the manner described on the Website. Prices are inclusive of GST unless otherwise stated. Prices are, however, exclusive of other taxes, duties and charges imposed or levied in New Zealand or overseas in connection with the supply of the Goods.
Where payment is by credit card, you will be liable for all Orders placed using your credit card and any additional third party processing fees charged. All third party charges are non-refundable.
Payment in full is due before the commencement of the training or consultancy shown above or 10 days after the invoice date, whichever is earliest. No credit unless previously arranged and approved in writing by IPM Services. Interest will be added to overdue accounts at the rate of 1.75% per month. The Purchaser is liable for any costs involved in the collection of overdue accounts.
5. Cancellation
A minimum number of participants are required to run each course economically. IPM Services reserves the right to postpone or even cancel the course due to a lack of participants. Should this happen we will give you as much notice as we are able and we will provide a refund should any alternative arrangement not be suitable.
If a registered participant is canceled or rescheduled five (5) or more working days before the original course commencement date and time then there shall be no cancellation fee. For private courses any non-refundable costs e.g. flights and accommodation will be due.
A cancellation or reschedule by a registered participant, more than one working day (24 hours), but less than 5 (five) working days, before the original course start time, 50% of the course fee will be payable in addition to any actual costs incurred. For a cancellation less than 24 hours before the start time or a 'no-show' on the day 100% of the course fee will be payable including any actual costs incurred. Acceptance or rejection of a 'late arrival' after the notified start time on the course date shall be at the sole discretion of the trainer on the day, should the participant be turned away on the day or asked to leave this 'late arrival' will constitute a 'no-show' as above with 100% of the course fee payable.
All cancellation fees will be at the sole discretion of IPM Services (NZ) Limited or their trainer representative. Registering on an IPM Services (NZ) Limited training course constitutes reading, understanding, acceptance and agreement to these Terms as per the course registration confirmation details communicated via email.
6. Code of Behaviour
IPM services and the participant agree to behave in ways that make our course experience safe, inclusive, engaging, educational and equitable for all. This means that everyone will act with manaakitanga.
Manaakitanga means all participants show respect, care and support for others and we act with kindness and hospitality. No one will:
- Bully, harass or discriminate against others;
- Engage in purposefully offensive or personal attacks, whether physical or non-physical;
- Behave aggressively, violently or in ways that make others feel unsafe or unwelcome;
- Abuse the power over others by virtue of the position or status held in the community.
At their sole discretion, the trainer without warning, at any time during the course is permitted to exclude a course participant, should the trainer feel anyone has breached this agreed Code of Behaviour. Any exclusion, at any time, shall constitute a participant initiated cancellation on the day in relation to fees payable.
7. Combined Terms
These Terms and Conditions together with any additional terms and conditions contained in the invoice or any other similar document, including but not limited to Privacy Stantements, Privacy Policies issued by IPM Services shall be the 'Terms' which govern your purchase of any Goods or Service.
8. Exclusion of Liability
Under no circumstances will IPM Services, its employees or its agents be liable to you in contract, tort, equity, statute, regulation or otherwise for any loss, damage, costs, legal costs, professional and other expenses of any nature whatsoever incurred or suffered by you, or by any other third party, whether direct or consequential (including, but without limitation, any economic loss or other loss of turnover, profits, business or goodwill) arising out of any dispute or contractual, tortious or other claims or proceedings made by or brought against you which relate in any way to Goods or Services supplied or statements made pursuant to an Order placed on the Website, traning porvided or in respect of any failure or omission on the part of IPM Services to comply with its obligations as set out in these Terms in respect of the sale of Goods or Services to you. If you are using the Website, or purchasing Goods or Services for a business purpose, you agree that the Consumer Guarantees Act 1993 does not apply.
9. Limitation of Liability
In the event that any limitation or provision contained in these Terms is held to be invalid or unenforceable for any reason and IPM Services becomes liable for any loss or damage that would otherwise have been excluded, Our maximum liability in contract, tort, equity, statute, regulation or otherwise for any loss, damage or injury directly or indirectly arising in respect of the supply of the Goods pursuant to an Order is to be limited to the lesser of the value of Goods or Service comprised in an Order to which a claim relates; the cost of repairing or replacing defective Goods; and the actual loss or damage suffered by you. All other warranties, descriptions, advice, representations and conditions as to fitness, suitability for any purpose or specific conditions, even though such conditions may be known to IPM Services, merchantable or otherwise, whether express or implied, and whether statutory or otherwise, are expressly excluded, except to the extent that such liability is required by law without right of exclusion.
10. Fitness for Purpose
You acknowledge that you have made your own investigations as to the fitness of the Goods or Service for your purpose.
11. Severability
If any provision of these Terms is held to be invalid, void, unenforceable or illegal for any reason, such provision shall be deemed to be severed from these Terms and the remaining provisions shall continue in full force.
12. Descriptions of Goods or Service and Availability
All descriptions of Goods, Services, specifications, quantities and prices of Goods and Services depicted on the Website are subject to change at any time without notice.
IPM Services will make all reasonable efforts to accurately display the attributes of the Goods and Services.
While IPM Services will use its best endeavours to ensure your Order is met, IPM Services provides no warranty as to the availability of Goods or Services ordered on the Website.
13. Pricing Errors
IPM Services will use all reasonable efforts and will take all reasonable care to ensure Goods or Services available for purchase on the Website are accurately priced. However, from time to time, certain products may erroneously be mispriced. Where a pricing error is identified, and you have placed an order IPM Servies reserves the right to cancel the order at its discretion and you will be provided a full refund if payment has been made. We will contact you to advise of the correct price and seek your instruction as to whether you wish to proceed with a new order at the correct price. IPM Services has no obligation to supply Goods or Services at the incorrect price.
14. Waiver
If we delay or do not exercise any of our rights or remedies under these Terms, that will not be a waiver of the right or remedy.
15. Retain a Copy
You should print out and retain or otherwise store a copy of these Terms for your future reference. An online copy is available on this website, the online version is subject to change at any time.
16. Queries
Please notify us as soon as practicable if you do not agree to these Terms. If you have any queries concerning these Terms please don’t hesitate to contact us.
17. Definitions
"Terms" means the 'General terms and conditions' and any addition 'Terms of Purchase' and 'Privacy Statement' and 'Privacy Policy' as outlined.
“You” or "Participant" means you, the user of this Website, the registered course participant, course attendee or the legal entity the course participant represents or their employer.
"Trainer", “We”, “Our”, "Us" "IPM" and “IPM Services” means IPM Services (NZ) Limited.
“Website” means the website at URL link https://www.ipmservices.co.nz and/or https://ipmservices.arlo.co/w/
"Service" means training course, training material, statements or advice provided by IPM Services on the website, in person, via email or phone.
"Goods" means product or service or material offered for sale by IPM Services
"Growsafe" means Growsafe or the New Zealand Agrichemical Education Trust (NZAET).
18. Your use of our website
You must not use this Website or contents therein: (a) for any unlawful act in breach of any legislation or regulations; or (b) to damage the reputation of IPM Services.
19. Copyright
This Website may contain material that is protected by copyright (or other intellectual property rights) owned by the IPM Services, its licensors or other third parties including Growsafe. Material on this Website for which we are the rights holder is to be used in accordance with the Copyright Act 1994. In relation to IPM Services copyright material, unless prior written permission has been granted by IPM Services or Growsafe, this material must not be reproduced, used, stored, transferred, distributed or modified. Unless prior written consent has been granted by the rights holder, you must not reproduce any material on this Website that has been identified as being owned by a third party. We cannot give permission to re-use such material.

Although we have endeavoured to provide accurate information and material on this Website, there may be inaccuracies, errors and omissions.
